Energy Law Practice
Downey Brand's energy attorneys have been extensively involved in many
of the most significant energy regulatory proceedings of the last 10
years, including the PG&E bankruptcy and many gas and electricity
restructuring proceedings. We advocate on behalf of clients before the
California Public Utilities Commission on matters including rates for
utility services, natural gas storage and delivery, distributed energy
resources, access limitations, publicly owned utilities, electric sales,
service territories, tariffs and market access, rulemaking proceedings,
utility asset sales, utility financing, and water utility concerns.
We negotiate with the investor-owned utilities regarding interconnection
issues and tariff implementation. We obtain permits and licenses for
both large power plant development projects before the California Energy
Commission and smaller projects subject to local permitting. We also
represent clients in jurisdictional investigations and rulemaking proceedings
before the California Energy Commission. When circumstances dictate,
we provide litigation advocacy for our energy clients.
Other services we provide to our energy clients include obtaining permits
for air quality impacts, securing water supplies and addressing discharges,
permitting biological impacts including endangered species issues, getting
local land use approvals, and complying with the California Environmental
Quality Act and the National Environmental Policy Act. We have both
developed community support and addressed community opposition.
Downey Brand's energy attorneys also represent clients in mergers and
acquisitions (for sellers, purchasers and financiers), contract drafting
and negotiation, fuel supply contracts, power sales and purchases, commodity
swaps and other forms of hedging agreements, land purchase and lease
transactions, and pipeline and electric transmission line right-of-way
acquisitions. We use our extensive knowledge of the energy industry
to structure transactions with the unique aspects of the energy industry
in mind. Our experience includes work with all major power sources including
gas (both large power stations and small distributed generation facilities),
geothermal, wind, solar, biomass and hydroelectric assets.
