Streamlining Provisions Won’t Apply to Delta Conveyance Project

On May 19, Gov. Gavin Newsom introduced a package of trailer bills to streamline approvals and fast-track construction of certain energy infrastructure, transportation, water, semiconductor and microelectronic projects to maximize federal infrastructure funding opportunities under the Inflation Reduction Act and/or Creating Helpful Incentives to Produce Semiconductors and Science Act. To streamline project approvals, the Governor’s proposal included provisions to expedite judicial review of the California Environmental Quality Act (CEQA) challenges for eligible projects. The package also proposed reforms to the Delta Reform Act of 2009 to streamline review processes for Delta Plan projects. These proposals were not technically a part of the state’s budget package, but the Governor tied them to his approval of the budget spending plan.
